Terms & Conditions

In the below Terms & Conditions Zoey Queenz Body Modification Specialist Academy will be referred to as "BMSA". No services will be provided by BMSA except in accordance herewith. In case of any conflict between these conditions, these conditions will prevail. No other agreement, representation, promise, undertaking or understanding of any kind unless confirmed in writing by an authorised representative of BMSA shall add, vary or waiver any of these conditions. In this Agreement the following expressions shall have the following meaning:

"Diploma" the training course set out in BMSA's confirmation letter together with any other services which may be agreed upon by both parties from time to time. 

"Fees" in the sum in which will be charged by BMSA for the provision of the course as advised by BMSA at the time of booking.

Course Provision:

BMSA shall provide sufficient resources in order to deliver the course to the student and shall, at all times remain professional and carry out the provision of the course with reasonable care and skill. Provision of the course provided by BMSA will be confirmed in writing  but time for the performance shall not be of the essence of the contract and BMSA reserves the right to amend the date, time and venue of the course should it be necessary and BMSA shall not be held liable for any delays however caused. All courses must be booked and paid for in advance. Students must present BMSA with confirmation of the booking upon attendance of the course. BMSA reserves the right to cancel the course or terminate a students participation of the course in the event that:

1. The student is late to attending the course. 

2. The student does not participate in the course to a satisfactory level.

3. The students behaviour is abusive, disruptive or unreasonable towards the educator or other students attending the course. 

4. BMSA believes that the student is not capable of completing the course to a satisfactory level. 

If BMSA exercises the right to cancel the course before commencement of the course than a refund minus the £500 non-refundable deposit shall be given. However is BMSA exercises the right to terminate a students participation in the course once the course has commenced then no refund shall be given. Upon successfully completing the course BMSA will issue each student with an individual certificate. 

 

Fee:

In consideration of BMSA providing the course to the student, the student shall pay to BMSA the Fee. The Fee is payable immediately upon the student booking the course and is non-refundable. In the event that BMSA agrees to accept a deposit rather than the full Fee upon the student booking the course then the deposit is non-refundable and the remaining balance of the Fee is payable 7 days prior to the course commencement date. In the event that the student fails to make the payments in accordance with the provisions set above, than BMSA shall be entitled without prejudice to any other rights it may have, to suspend the provision of the course without liability until payment in full of all outstanding sums has been paid. In the event that BMSA has to chase the payment of any outstanding fees due to BMSA then BMSA is entitled to charge an administration fee of £50.00. BMSA may choose to waiver this fee as per BMSA's discretion.

Confidential Information:

Both parties recognise that it may be necessary for one party to disclose confidential information. Each party agrees to accept approval prior to disclosing of this information. Each party agrees to safeguard all records of the other party whether in writing or in electronic data. All records will remain exclusive.

Liability:

LRTA shall not be liable of breach of contract or breach of statutory duty in any manner for any consequential or indirect loss suffered by the student. BMSA will not be liable for any direct loss or damage suffered or incurred by the student and gives no guarantee or warranty of successful completion of the course. BMSA does not guarantee a result in employment nor does it guarantee that the course will be recognised in any other country other than the UK. BMSA warrants to provide the course in a timely manner and to the best of their ability using reasonable care and skill.

Cancellation:

This agreement comes in to effect on the day that BMSA sends written confirmation of the course and shall remain in effect until the course is completed. BMSA may reschedule the course date, time and venue by giving written or electronic notification within 72 hours of the original course commencement date. If the student decides to terminate the contract prior to the course commencement date then a partial refund of the full fee will be given at BMSA's discretion. BMSA does not refund any deposits as this fee is immediately used after to cover consumable and other course costs. No refund will be given in the even a student does not attend the course for whatever reason. If the student wishes to change the date of attendance then they must give written notification 14 days prior to the course commencement date. LRTA will do this at no extra cost however, in the event this is not possible to accommodate then no refund of the fee will be given.

Notices:

Any notice required to be given thereafter by either party to the other shall be in writing and shall be served by sending to either party via registered or recorded post to which the other party has given herein or to such address the other party may have previously given. All notices and documented communication and any other data to be provided under this Agreement shall be in English.

Free Kits:

The free piercing kits are to be used solely for the purpose of you continuing your training and are not for resale. You will receive them upon completion of the course and not beforehand. In order to pass the course you must get over 80% on both Theory and Practical Assessments.

Certification & Course Completion:

Upon completion of the course you will receive certification. All courses are CPD Accredited and will come with their official logo. To pass the course you must obtain a 80% pass mark on both Theory and Practical Assessments. Failure to pass will result in a £50.00 administration fee to resit the failed assessment. There is no limit as to how many times you may resit the assessment however, an administration fee will be applied according to each re-assessment.
